IMEAS web Platform’s Terms of Use

Preface
The IMEAS web Platform is the name of the knowledge sharing web platform developed in the framework of the IMEAS (Integrated and Multi-level Energy models for the Alpine Space) project co-financed by the European Regional Development Fund through the INTERREG Alpine Space program.

In brief…
• You are legally responsible for any content that you contribute to the IMEAS web Platform, including all associated liabilities and obligations.
• You retain full ownership of any content that you contribute to the IMEAS web Platform, including intellectual property rights. Ownership includes the right to access, amend and replace/delete content at any time through the IMEAS web Platfrom’s content management system, free of charge, or through the intervention of IMEAS Web Platform Administrators.
• By contributing content to the IMEAS web Platform, you agree to a non-exclusive royalty free license allowing the IMEAS web Platform to use, share and derive information from the content you provide. This does not mean that you surrender ownership of the content – it simply grants us permission to display the content via the IMEAS web Platform, the IMEAS website and their social media channels.

1. General
1.1 The IMEAS web Platform is a website developed to share/give access to contents (like tools, guidelines, documents, etc.), promote Events and News and meet Stakeholders and Experts on topics concerning energy and climate.
1.2 By accessing www.imeas.eu and its related services, applications, contents or tools (collectively referred to as “IMEAS web Platform”) you are agreeing to the following terms, which are designed to make sure that the IMEAS web Platform works for everyone. These Terms of Use constitute a legally binding agreement between you and the IMEAS web Platform. You accept these Terms of Use by ticking “I accept the Terms of Use” when registering to the IMEAS web Platform providing a username and your email address and by otherwise accessing or using the IMEAS web Platform website, services, applications.
1.3 The IMEAS web Platform is developed in CSM WorPress.org.
1.4 The IMEAS web Platform has a Public Area, displaying general information on the IMEAS Project and on the contents of the IMEAS web Platform (list and preview of news, events and products) and an Area for Registered Users, giving access to full contents (news, events and products) and to the possibility to upload user generated contents.
1.5 Users are individuals that access the Public Area of the IMEAS web Platform, without registering.
1.6 The Registered Users are Users that access the Area for Registered Users of the IMEAS web Platform, after registration to the IMEAS web Platform (see Section 2).
1.7 The Registered Users of the IMEAS web Platform are Users are hereinafter referred to as “Registered Users” or “Contributors”.
1.8 Registration to the IMEAS web Platform is free of charge.
1.9 There are no fees for using the IMEAS web Platform’s services.
1.10 Any content made available through the IMEAS web Platform is hereinafter referred to as “Contribution”.
1.11 The Contributor is the solely responsible for all information that he/her submits to the IMEAS web Platform and any consequences that may result from contributing information.
1.12 The IMEAS web Platform Operator is ENEA, coordinator of IMEAS project.
1.13 The IMEAS web Platform Operator is responsible for the operation, hosting and maintenance of the IMEAS Platform.
1.14 The IMEAS web Platform Administrators are employees and collaborators.
1.15 The IMEAS web Platform Operator and Contributors recognize that any system that is open enough to allow the greatest possible participation of the general public will also be vulnerable to certain kinds of abuse and counterproductive behaviour. IMEAS web Platform Adminstrators have established a number of mechanisms to prevent or remedy abusive activities, and to protect personal related data against unauthorized sharing or unauthorized access, accidental or unlawful destruction, loss or alteration.

2. Registered users
Natural persons, legal entities like organisations and enterprises may register on the IMEAS web Platform.

2.1 The registration process consists of the following phases: 1. indication of a username and a valid email address; 2. confirmation and set of the password; 3. indication of mandatory personal and professional information (name and surname,xxx).
2.2 The registration is pending approval by IMEAS Administrators. The approval usually requires up to 2 days.
2.3 The user registration is valid upon receipt of a confirmation email.
2.4 Registered Users can upload Contributes to the IMEAS web Platform (documents, tools, news, events, etc.). The Contributes are pending approval by the IMEAS web Platform Administrators.
Registered users acknowledge that:
2.5 Professional and personal information of Registered Users (Contributors) are visible to all registered users in the Community page;
2.6 When a Contribution is published on the IMEAS web Platform, the name and surname of the Contributor that uploaded it will be displayed and visible to the other Registered Users.
2.7 Registered Users are not allowed to share the registration credentials or give them to anyone else. The Registered User is responsible for maintaining the registration credentials confidential and obliged to notify the IMEAS web Platform Administrator of any known or suspected breach of security, including loss, theft, or unauthorized disclosure.
2.8 Registered Users shall be responsible for all usage and activity on the account and on Platform, including use of the account by any third party not depending whether authorized to use by the User or in abuse.
2.9 Any fraudulent, abusive or otherwise illegal activity may be grounds for termination of the account at the sole discretion of IMEAS web Platform Administrators.
2.10 Passwords are encrypted, they are not known to the IMEAS web Platform administrators.
2.11 The email address of a Registered User may be used by the IMEAS web Platform Administrators for communication with the User for the purpose of IMEAS web Platform.
2.12 If a Registered User does not longer dispose over a valid email address, he/she will not be able to reset the password if it is lost. In such a situation, however, Users may be able to contact the Support Team to enter a new email address.
2.13 User accounts may be fully removed only upon request (de-registration).

3. Use of the IMEAS web Platform
3.1 As a condition of your use of the IMEAS web Platform you agree that you will not:
– violate any laws;
– post or upload any threatening, abusive, defamatory, obscene or indecent material;
– post or upload or otherwise communicate any false or misleading material or message of any kind;
– infringe the copyright, trademark or other rights of third parties;
– distribute spam, chain letters, or promote pyramid schemes;
– distribute viruses or any other technologies that may harm The IMEAS web Platform or the interests or property of the IMEAS web Platform users;
– post or upload contribution that is qualified either as marketing or advertising, or as unauthorized or unsolicited commercial communication;
– impose or contribute to imposing an unreasonable load on our infrastructure or interfere with the proper working of the IMEAS web Platform;
– disrupt or threaten the integrity, the operation or security of the IMEAS web Platform, and any other computer or internet system;
– disable or circumvent any access control or related process or procedure established with respect to the website of the IMEAS web Platform.
– extract, gather, collect or store personal information about any othe person;
– copy, modify, or distribute any other person’s content without their consent;
– use any robot spider, scraper or other automated means to access the IMEAS web Platform and collect content for any purpose without our express written permission;
– harvest or otherwise collect information about others, including email addresses, without their consent;
– copy, modify or distribute rights or content from the the IMEAS web Platform site, services, applications or tools or the IMEAS web Platform’s copyrights and trademarks;
– bypass measures used to prevent or restrict access to the IMEAS web Platform.
3.2 The Contributor is the solely responsible for all information that he/her submits to the IMEAS web Platform and any consequences that may result from contributing information. The Contributor continue to be responsible for ensuring that the content is accurate, does not include misleading information and is fully compliant with these Terms of Use. If he/her notice inaccuracies in his/her content after it appears on the site please get in touch with the IMEAS web Platform Administrators and write an email to info@imeas.eu.
3.3 The Contributes are pending approval by the IMEAS web Platform Administrators.
3.4 IMEAS web Platform Administrators reserve the right at their discretion to refuse or delete content that they believe is inappropriate or breaching the above terms without notice. They also reserve the right at their discretion to restrict a Registered User’s usage of the IMEAS web Platform either temporarily or permanently, or refuse a User’s registration.
3.5 The IMEAS web Platform works to keep the IMEAS web Platform website, services, applications and tools functioning properly and the community safe. Please report problems, offensive content and policy breaches to us immediately.
3.6 Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Tthe IMEAS web Platform if we think that they are creating problems, infringing the rights of third parties or acting inconsistently with the spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off the IMEAS web Platform or not, we do not have any obligation to monitor the information transmitted or stored on our website, services, applications and tools and we do not accept any liability for unauthorised or unlawful content on the IMEAS web Platformor use of the IMEAS web Platform by users.
3.7 Some of The IMEAS web Platform’s features may display content you have submitted on other sites, services, applications and tools (such as those belonging to organisations that are partnered with or otherwise working with the IMEAS web Platform). By using The IMEAS web Platform, you agree that your content can be displayed on these other sites, services, applications and tools.
3.8 The IMEAS web Platform contains content supplied by us, you and other users. The IMEAS web Platform is protected by copyright laws. You agree not to copy, distribute or modify content from the IMEAS web Platform without the express written consent of the owner(s).

4. Liability

4.1 The User is solely responsible for the content of his Contributions to the IMEAS Platform. Therefore, the User is liable for the legality, correctness, completeness and accuracy of the Contributions. The User shall have as content provider the sole legal responsibility with regard to Copyright Law, Media Law, Unfair Competition Law, Data Protection Law and any other applicable law aspects depending on the jurisdiction that applies to the relevant facts. Particularly, the User guarantees that the Contributions do not violate any third-party rights, including any copyright, trademark, patent, trade secret, and privacy right, right to secrecy or any other intellectual property or proprietary right.
4.2 Do not post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright, design and trademark. Entitled parties, in particular owners of copyright, trademark rights or other rights can report any content that may infringe on their rights and submit a request for such content to be removed. If a legal representative of the entitled party reports this to us in the correct manner, products infringing on the intellectual property rights will be removed by the IMEAS web Platform.
4.3 ENEA only provide the infrastructure for the functions as described under Section 1.10 of these Terms of Use.
4.4 IMEAS web Platform Administrators are not obliged to analyse the content of the Contributions, whether it complies with applicable law prior to uploading and making available through IMEAS Platform by a User. However, as soon as the Administrators become aware of an illegal content, Administrators shall have the right, but not the obligation to delete the content forthwith. Therefore, albeit the User is solely responsible for the content of the Contributions, Administrators reserve the right to delete, move, or edit Contributions that, in its sole discretion, deem abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable. Further, Administrators shall be free to reject the publication of Contributions if the suspect arises that the content is illegal or otherwise inadmissible.
4.5 ENEA is only the host provider and hence not responsible for the content of the Contributions as such (see Section xxx). IMEAS Operators, therefore, assume no legal liabilities for any losses or damages, caused by the use or non-use of provided information on IMEAS Platform or the use of erroneous or incomplete information on IMEAS Platform, or the reliance upon such information. It is the responsibility of the User to evaluate the legality, accuracy, completeness or usefulness of any Contributions.
4.6 The services of the IMEAS Platform are provided on an “as is” basis without warranties of any kind, including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose.
4.7 IMEAS Operators on its behalf make the services of the IMEAS Platform available through the internet, but is under no obligation to make any particular scope of access or possibility to use or content available. Access to IMEAS Platform and availability of any information is not guaranteed, nor does IMEAS Operators ensure that it will be uninterrupted or error free. The IMEAS Platform is subject to outages, communication and data flow failures, interruptions and delays inherent in Internet communications. The User recognizes that problems with the Internet, including equipment, software and network failures, impairments or congestion, or the configuration of the computer system of the User, may prevent, interrupt or delay access to the IMEAS Platform. ENEA and/or IMEAS Operators are not liable for any delays, interruptions, suspensions or unavailability of the platform. Further, IMEAS Operators make no representation that the Contributions or any other content in IMEAS Platform will be available, complete, uninterrupted, error free or free from viruses or anything else of similar destructive qualities. The User acknowledges by accepting the TOU that use of IMEAS Platform and its services hereunder are at its own sole risk.
4.8 Nothing in these terms shall limit our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other users post or do.
4.9 IMEAS web Platform do not review all users’ postings and is not involved in transactions between users. As most of the content on the IMEAS web Platform comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered.
4.10 In no event do the IMEAS web Platform Operator and Administrators accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.
4.11 The Users acknowledges that the IMEAS web Platform Operator cannot guarantee continuous, error-free or secure access to its services or that defects in the service will be corrected. While the IMEAS web Platform Operator will use reasonable efforts to maintain an uninterrupted service, it cannot guarantee this and it does not give any promises or warranties (whether express or implied) about the operation and availability of its sites, services, applications or tools.
4.12 Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. The IMEAS web Platform Operator and Administrators are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use the IMEAS web Platform, even if you advise us or we could reasonably foresee the possibility of any such damage occurring.
4.13 If you have a dispute with one or more the IMEAS web Platform users, you release the IMEAS web Platform Operator (our agents and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.

5. Links to third-party websites

5.1 The IMEAS Platform may contain links to third-party websites. Such links are provided solely as convenience to the User and not as an endorsement by the IMEAS web Platform, IMEAS web Platform Operator or IMEAS Project of the content on such linked websites. Links from this site to other sites do therefore not imply that the IMEAS web Platform, IMEAS web Platform Operator or IMEAS Project approve these sites, endorse or recommend them. Neither they are responsible for the content of such linked websites and do not make the content of these sites as their own. The IMEAS web Platform Operator makes therefore no representations and warranties regarding the correctness, accuracy, performance or quality of any content at such linked websites. The IMEAS web Platform Operator is not responsible for the availability of the linked sites or the content or activities of such sites. If the User/Registered User decides to access linked websites this occurs at User´s own risk.

6. Licensing of Content

6.1 The User grants the IMEAS web Platform Operator and Administrators a perpetual, nonexclusive, world-wide, royalty-free license to use, modify and translate, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, modify, and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technology) in any form or media now known or hereinafter developed, any Contribution provided by the User on IMEAS Platform.
6.2 The Registered User that provides a Contribution acknowledges that any Contribution may be edited, removed, modified, published, copied, made available to the public, transmitted and displayed by the IMEAS web Platform or any designated third party. Contributions may also be made available for republishing through other formats. Further, the User acknowledges that neither the IMEAS Operator and the Administrators are obliged to use the Contributions in whole or in parts or as derivative work.
6.3 Contributions available through the IMEAS web Platform remain in property of the respective rights holders, authors or contributors and do not pertain to IMEAS Platform. The content of the Contributions accessible through the IMEAS web Platform can be freely used by Registered Users. Without limiting the foregoing, the available information, data and Contributions whether in whole or in parts may not be collected, copied, made available to the public or otherwise used repeatedly and systematically. The use of IMEAS Platform by means of programs and electronic applications, crawlers or any similar software is prohibited.

7. Term

7.1 IMEAS web Platform Operator may in their sole discretion suspend, restrict, or terminate an account and the use of IMEAS web Platform by a Registered User, effective at any time, without prior notice to the User, for any good cause, including because the operation of efficiency of IMEAS web Platform or IMEAS web Platform Operator´s or any third party´s equipment or network is impaired by the use of IMEAS web Platform by this Registered User, because IMEAS Support Team has received a third party complaint which relates to the use or the misuse of IMEAS web Platform, or the Registered User has been or is in breach of any term or condition of these Terms of Reference.
7.2 It is planned that IMEAS web Platform will be operated for 5 years after the end of the IMEAS project.
7.3 The Registered User may terminate his account at any time by writing an email to the Support Team (info@imeas.eu). Upon termination the Registered User shall receive an automated confirmation via e-mail that the cancellation was processed.

8. Privacy
IMEAS web Platform is compliant with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). This Regulation protects fundamental rights and freedoms of natural persons and in particular their right to the protection of personal data. The Privacy Policy is availablehere.

The IMEAS web Platform uses cookies. By accessing the IMEAS web Platform you consent to the use of cookies. The Cookie Policy is availablehere.

10. Modification of Terms of Use
IMEAS web Platform reserve the right to amend and modify the Terms of Use at any time. The Registered Users will be provided notice of any such amendment or modification by electronic mail or by publishing the changes on the login page of IMEAS Platform. The User accepts the changes with his next login.
